Contracting Party
ORPHEO is a brand operated by LUXERY BY XANDRA LLC, a Nevada limited liability company. Purchases through ORPHEO are made with LUXERY BY XANDRA LLC as the operator of the ORPHEO brand.
1. Scope
These Terms govern the use of Orpheo and the purchase of digital and physical products, including private listen pages, QR-linked gift experiences, personalized certificates, jewelry, gift cards, and space transmissions. Purchases through ORPHEO are made with LUXERY BY XANDRA LLC as the operator of the ORPHEO brand.
2. Accounts & Use
You agree not to misuse the service or infringe third-party rights.
3. Pricing & Payment
Payments are processed by Stripe. Taxes and shipping are shown at checkout where applicable.
4. Voice Message Finality
Once purchased, the voice message becomes part of the Orpheo Cosmic Transmission Archive and partner transmission workflow, and cannot be changed afterward once personalization or production has begun.
5. Delivery & Fulfillment
Digital access is available immediately where applicable. Physical certificates are fulfilled by Prodigi, jewelry is fulfilled by ShineOn, and delivery timelines vary by region. Space transmission experiences are facilitated through our transmission infrastructure and partners.
6. IP
Designs, templates, and the Orpheo brand remain our IP. You retain rights in your audio and personalization content, which you license to us for the private listen page, QR-linked gift experience, personalized certificate, physical fulfillment, and space transmission.
7. Liability
Liability is limited to intent and gross negligence where permitted by law. We are not liable for indirect, incidental, or consequential damages except where mandatory law provides otherwise. We do not guarantee uninterrupted availability of the website, private listening pages, payment systems, or third-party fulfillment services. Delivery timelines are estimates only and may be affected by production partners, carriers, customs, force majeure events, technical issues, or circumstances outside our reasonable control. Mandatory consumer protection rights remain unaffected.
8. Governing Law
These Terms are governed by the laws applicable to LUXERY BY XANDRA LLC in Nevada, USA; mandatory consumer protections remain unaffected.
